If I understand this correctly, it is no longer a felony to have sex with someone, with no condom, and without disclosing that you are HIV positive.

I do understand that with modern medicine and technology, viral loads can be very low, and chance of infection tiny, but still I would want to know if the person I was about to have sex with was HIV positive?

Then there is this. I guess not everyone agrees with FSC and California government.

Well, Mike South's battles with the FSC on everything from the condom mandate to everything else is well documented.

This issue seems to me to be yet another boilover from the condom wars of the past 5 years. Quite literally, many of the same group of performers who were opposing FSC and either backing or close to backing AHF on the condom mandate are the same ones now ripping at FSC over this issue. They do have plenty of merit due to the fear of allowing HIV+ performers to do shoots without disclosing their status; but the FSC's desire to fight against antidiscrimation also has some merit as well.

There's also the fallout over the recent sexual harassment/sexual abuse revelations of Hollywood of late, which has spilled over into the porn biz due to the recent accusations over James Deen and Ron Jeremy over sexual assault. In addition, there's the continuing story of Nikki Benz's accusations of assault on the set of Brazzers last year; made a bit more explosive by the fact that the accused producer, TonyT, hired none other than FSC legal counsel Karen Tynan to be his chief counsel for his defamation lawsuit. That's ruffled plenty of feathers among some performers as well.

I do think that with PrEP and better screening of viral loads, it is more possible today for someone who is HIV+ but with a near zero viral load, to not infect a non-HIV person. I'd much rather not take that risk, though. At least FSC would retain the testing regime that has worked so well; AHF would remove it entirely and simply tell performers to trust that the condom doesn't break. HIV+ performers, though, should be upfront and transparent about their condition; and non-HIV performers should have the right to not have to perform with them without fear of lawsuits or coercion. (And also, if they explicitly wish, the right to perform with them if they are willing to take that risk.)
