Should Michael Nifong be disbarred as an attorney in North Carolina

Well, Michael Nifong officially resigned his post as the Durham County North Carolina District Attorney on Friday...

He was the lawyer who was trying the three Duke University lacrosse players for rape, sodomy, and other indecent charges against the erotic dancer/stripper who came to entertain the team at their living quarters....

(The players charged were white; the entertainer is black)

1. The dancer changed her story so much and so many times that she couldn't be believed.

2. Nifong, as the district attorney, publically badgered the three defendents in all the local papers. These statements were then picked up on the national stage...

3. ...His main intent among other things was to win election five months ago in the Durham County DA seat.

4. Nifong, then knowingly hid valid DNA evidence from the defense team. This DNA evidence would have exonerated each player accused.

5. He also knew that the testimony of the stripper was false. He shouldn't have proceeded furher but chose to regardless...

6. The North Carolina Supreme Court, on the advice of the North Carolina Attorney General, dismissed the charges againt the three Duke University players.

7. Michael Nifong has publically apologized to the players and to their families. These players and their families have had their lives turned upside down and these players' lives and careers will always "be marked on the downturn", in effect; their lives are ruined as well...

8. The North Carolina Attorney General recommended that Nifong be brought up on ethics charges. The North Carolina Bar Association is now conducting hearings to determnine if Michael Nifong should be found guilty of ethics violations in this case. These adverse charges could be grounds for his disbarrment as an attorney in the future.

9. The players, on the advice of their legal counsel, are still pondering their legal rights, one of which, is to later bring a civil lawsuit against Michael Nifong. Legal experts are saying they have a great shot at winning a judgement against Mr. Nifong.

Question:

Do you think he should be disbarred after everything is said and done?

Now, I am one who actually did sympathize with the accuser in this case in the beginning, and was and still am horrified at the abuse thrown at her for even making the accusation of rape. (She was basically defamed as a nut, a slut, a reverse racist, and a political pawn used be evil Blacks and their liberal/radicalfeminist allies to smear these boys and by extension, all White people.)

I still do feel that something did indeed happen to her at that party, whether or not it got as far as actual rape we will never know.

Nevertheless, I agree that Nilfong should be disbarred...indeed, given the damage that his actions have done for those who have truly been raped (not to mention his abuse and playing the Black community in Durham for suckers and his own political gain), I'd be in favor of putting his ass under the jail for a year or 20. And I'm a staunch supporter of feminism who tends to favor rape accusers to begin with....unless the evidence proves otherwise.

Well, as you all may know by now, it's a moot point, as he has been disbarred. Once the real details started coming out, it was obvious that he needed some sort of sanction.

In a way, I agree with you, Anthony. In most every national case, there are always dweebs, dorks and bozos who crawl out of the woodwork to badmouth even true victims. I saw slanderous, defamatory comments aganst Lacy Peterson (she was cheating on her husband and deserved what she got) and have seen many others. But, in the case of this dancer, even her 'friends' who were there with her, say that nothing happened. I generally don't pay attention to slanderous comments until the facts come out. I know that many people will always spout their whatever feelings as fact. (Mom or Dad says, "My son did not do that," even tho a witness saw him do it. Same for a defense atty, "My client did not commit that crime. He was in BumFuck, Egypt at the time." "Mr. Attorney, how do you know he didn't do it? How do you know he was in Egypt at the time?" "Why, he told me so, that's how!!!")
(Oh, and your capitalism of "Black" and "White" in this instance, is correct. I don't know all the rules, etc., but it has something to do with the usage. In your usage, the words designate a specific item or group of things, i.e., a race of people. Possibly a proper noun?)

Well since he has already been disbarred , it is not a moot point. The fall out of this stupid DA's criminal action has not yet begun. Every criminal this man has sent to prison in his time as District Attorney well be hiring lawyers at the state of North Caroline expense to have their cases over turned and retried. There will be law suits from everybody that feels they were wronged in the court system there.

What is so alarming is we do not know how many Michael Nifonges there is in the justice system across the country in the local to the federal systems. It only proves once again that everyone in goverment it only out for them-selves. Things like this hurts all of us.

What I meant, Donor, was that the question of "should he be disbarred" is moot, meaning, irrelevant, as it has all ready been done. He has been disbarred. I guess it is relevant, tho, for everyone to still have an opinion as to 'should he or shouldn't he be.' However, everything you say is true. When one idiot uses the system for his own personal gain, as this guy did, it brings discredit to the whole system.
