Now, many file sharing sites prevent such thievery by not allowing file uploaders to share their files with others. Why doesn't depositfiles do the same??

Vicky, you may have to jack them up the way you did RapidShare.

Plus, is there a way you can monitor member's IP addresses to see if they are doing excessive downloading and then uploading to these sites? Then, take away their memberships?

It may also be someone theiving from a member who downloads files for legitimate personal storage on their PC, but gets hacked into via bit torrent.

It may be a good idea for legit downloaders to lock down their files with passwords to prevent prying eyes or bots or thieves from looting them.

It's interesting that the material he's/she's posting is usually the mp4 files which take far less time to download and upload.

My own scattered thoughts on this article:

The implication here seems to be that the DMCA isn't strong enough to protect copyright holders from piracy, and that more direct means, including the popular practice of suing users and downloaders directly, or Pefect 10's practice of suing everyone in sight who even allows downloading of images, would be more effective.

The problem is, though, that DMCA can also be misused and abused as a means of shutting down legitimate speech and satire. I know of this first hand and personally, because a mirror video I made spoofing Shelley Lubben (the antiporn "ex-slut" activist) was flagged and my account suspended temporarily due to an DMCA takedown request by Lubben's holding company.

Also, it's not as if the already rabidly antiporn forces that currently run Congress will be willing to extend even the most minimal copyright protection to adult sexual entertainment without a firestorm of protest from the Religious Right and the antiporn "feminists".

But, I think that the most fundamental issue is that technology simply makes it too easy for people to download content to their PC's..and since most d/l's are done by legitimate paying members (or by "mules" who are paid to join sites legitimately, then loot them) and upload them to "tube sites" or "file locker" message boards. Though most downloaders are legitimate members who do respect the performer's content, those who aren't usually make the argument that "Well, I paid for a membership, so I should be able to download what I want and post it anywhere, and the model shouldn't complain since without us sharing "free" porn, she wouldn't even make a buck!!!"

Short of a totalitarian state where individual users are targeted for financial punishment via lawsuits, or government intervening with laws like SOPA or CISPA to impose copyright protection at the expense of free speech, I'm not sure there is an easy solution to this that balances the right of adult producers and providers to make a reasonable profit on their labor and the viewer's rights of ownership over what they have bought. I do think that Vicky's ongoing suit against AFF is one method that could be immensely profitable, due to the misuse of her DHD images. The lure and "entitlement" of "free porn", however, will be a tough nut to crack..and if the condom mandate happens to pass in LA and is extended nationwide, then that will create even more of a piracy frenzy, because bareback porn will all of a sudden become a tradable commodity for shysters looking for a quick buck.

That's how I see it, at least for now.

While it soulds like a good idea on the face of it, I think the Electronic Frontier Foundation made some valid points. Something like this needs to be very carefully thought out and very carefully implemented. You want to punish the bad guys, but not the good guys who get caught in a bad algorithm.

The industry is heading down an interesting path. Manwin is gobbling up websites to control it's material, pornstars are "retiring" to work solely for themselves, file hosting sites are disappearing daily, some pornstars have actually stopped updating their websites or have announced that they will no longer be releasing new material because of the theft and sharing.

I applaud websites like the VNA girls and a few others that have the fans, the loyal paying fans, in their interests first.
